Integration of Conventional and Digital Law: A Study of the Validity of Electronic Agreements in the Perspective of the Civil Code and the ITE Law
Abstract
The development of information technology has influenced various aspects of life, including the legal aspects of contracts. Electronic agreements have become a common phenomenon in digital transactions. However, the existence of electronic agreements raises legal questions regarding their validity and binding force in the Indonesian legal system. The Civil Code, which is the legal basis for agreements, does not explicitly regulate the form of electronic agreements, while the Electronic Information and Transactions Law (UU ITE) has provided legal recognition for electronic information and electronic signatures. This study uses a normative approach with literature review and qualitative legal analysis. The results show that although the substantive requirements for valid agreements in the Civil Code still apply, the form of implementation can be adjusted to comply with the provisions of the ITE Law. The integration between these two legal systems creates a legal basis for recognizing and enforcing electronic agreements in Indonesia. However, further synchronization is still needed to avoid overlapping and legal uncertainty in the future.
